This website is run by Row & Co Pty Ltd. When the terms “we”, “us” and “our” are used they are referring to Row & Co and the team of people whom run the company. Our store is hosted by Shopify Inc. They are an online e-commerce platform, which provides us the tools to be able to present and sell our products and services to you. By agreeing to our Terms and Conditions this includes the terms of using Shopify Inc.

ONLINE STORE TERMS & CONDITIONS

By agreeing to our Terms and Conditions, you agree that you are at a legal age within your Country of residence and consent to the use of our site to any minors under your care. You may not use our products for any illegal or unauthorised purpose or violate any laws in your jurisdiction such as copyright laws. You may not infringe upon or violate or intellectual property rights or that of others.  You must not transmit any viruses, bus, worms or any code with the intent to do damage. A breach of any Terms and Conditions will result in an immediate termination and you will be blocked from being able to use our services in the future.

GENERAL TERMS AND CONDITIONS

We reserve the right to refuse service to anyone for any reason at any given time. We will not tolerate any abusive behaviour and this will result in immediate termination of our services provided to you. Your content (not including payment information) may be transferred unencrypted and involve - transmissions over various networks and – changes to conform and adapt to technical requirements of connecting networks and devices. Credit card details are always encrypted. You agree not to copy or resell any part of the service we provide, unless approved in writing by us.

PRICES AND SERVICES SUBJECT TO CHANGE

We reserve the right to change our products and/or the prices shown at any given time, without notice. Also we may discontinue a service or product at any given time and without notice. Products and services are available online only and in limited quantities depending on our stock and warehouse capacity. Exchanging products is limited and subject to availability. PRODUCT AND SERVICES

Product displays including colour are as accurate as possible. We are not responsible and cannot guarantee how these will present on your screen. We reserve the right to limit the products and services provided to any individual, representative, company or regional area. We make every effort to ensure the product is in good condition when the buyer receives it. However, we are not responsible for the product and how it is presented once it leaves our hands.

RETURNS

If you are unhappy with your purchase and would like to return it, please contact us on admin@fortunatepaws.com Customers are entitled to refund their items if they are unsatisfied. However, we do limit the number of refunds to one per customer per order. Returns must be submitted and sent back to us within 30 days of buyer receiving order. You shall be responsible for all costs incurred to send the item back to us. Refer to our Returns & Refunds Policy for more information.

SHIPPING, BILLING AND CUSTOMER INFORMATION

Once an order has been placed through our site, you agree for us to use the shipping address you provide. We are not responsible for these details and if there are any inaccuracies you are responsible. We use an external shipping provider and the details you provide will be used. We are not held responsible for any delivery errors that may result from this. It is your responsibility to check the information provided is accurate during the checkout process. We reserve the right to refuse an order. We may limit the quantity purchased. In the event that we do change an order, we will attempt to notify the customer with the details provided. We are not responsible if these details are incorrect in any way and we cannot make contact with the account holder. Under these Terms and Conditions you agree to provide current and accurate information including full name, email, payment information and shipping address. If these details were to change, you agree to update them as soon as it is possible for you to do so. It is your responsibility to notify us so that we can complete your order. We will not be held responsible for any orders unable to be fulfilled to due incorrect account information.

WEBSITE ERRORS

From time to time there may be typographical errors or inaccuracies on our site that may relate to product descriptions, promotions, availability, pricing and shipping charges. We reserve the right to correct any errors and update the information. If need be, we may need to cancel orders relating to such errors and not provide notice. However we will do our best to provide the customer with support regarding these changes.

We cannot guarantee the use of our service will be uninterrupted and error-free. We reserve the right to remove our site and product availability from time to time, for indefinite periods, as we see fit and without notice to you. In no case shall Row & Co, our directors, employees, affiliates, contractors, suppliers or service providers be liable for any injury, loss, claim, or any damages including loss of savings, loss of data, replacement costs or any similar damages due to your negligence or misuse of the product and service. You agree to defend and hold harmless Row & Co and any employees and affiliates, from any claim or demand, including attorney fees, made by a third-party from issues regarding you and your breach of these laid out Terms and Conditions, or any violation or breach of any law or rights of said third-party.

TERMINATION

It is your right to terminate your agreement to these Terms and Conditions at any given time. Until such time these Terms are to be adhered to. If you wish to terminate these Terms and Conditions you may notify us of said termination or cease using our site. We have the right to terminate your use without any notice.
